Medical Internet Associates Acceptable Use Policies

Please read these Acceptable Use Policies ("AUPs") and the Terms and Conditions. By using our services, you agree to comply with these Acceptable Use Policies, and UKMIA may terminate your account if you deliberately fail to comply with these guidelines. These AUPs are common sense guidelines for use of the Internet and are designed to allow all users to enjoy use of it.

Our Terms & Conditions, which are set out at http://www.ukmia.org/terms.asp, are to be read in conjunction with these AUPs.

1. Medical Internet Associates (UKMIA) reserve the right to investigate suspected violations of the AUPs. When UKMIA become aware of possible violations, UKMIA may initiate an investigation, which may include gathering information from the customer involved and the complaining party, if any, and examination of material on our servers. Many of the AUPs reflect acts which may constitute breaches of United Kingdom legislation or regulations and may in some cases carry criminal liability.

2. During an investigation, UKMIA may suspend the account involved and/or remove the material involved from our servers. If UKMIA believe that a violation of these Policies has occurred, UKMIA may take responsive action. Such action may include temporary or permanent removal of material from our servers, the cancellation of newsgroup postings, warnings to the customer responsible, and the suspension or termination of the account responsible. UKMIA will determine what action will be taken in response to a violation on a case-by-case basis. Violations of the AUPs could also subject the customer to criminal liability. Certain UK regulatory authorities, including the Police and the Office of Fair Trading, also have wide investigatory powers, which may require us to disclose information. UKMIA have a policy of open co-operation with UK regulatory authorities.

3. There is a 10,000 hit per day per account limit on web sites owned by Customers. Customers whose web pages are generating hits in excess of the limit may receive a warning from us. Continued excessive use of our web server resources may result in a re-evaluation of the tariff for the customer, or suspension or termination of the account. A hit is understood as an image or html page downloaded at the request of an Internet user; multiple graphical images on one web page are deemed as multiple hits.

4. All the conditions of use apply, including the security of your web space, and its passwords.

5. You are required to keep the your contact details held by UKMIA up to date.

6. A page called index.htm, index.html, default.htm or default.html within the root directory of your web space will always be maintained.

7. No CGI scripts other than those supplied by UKMIA may be used. Requests for additional CGI scripts maybe made to support@UKMIA.net.

8. No support is available for HTML authoring.

9. No access logs or visitor statistics will be made available unless specifically requested by a Customer as part of the Medical Consultant Web Package.

10. You are responsible for the backup of your data. UKMIA will not keep backups of your pages.

11. UKMIA accepts no responsibility for any loss of data, information in any form or other matters whatsoever which result from the use of this service.

12. You are solely responsible for the content of your web space, and related web site, and must ensure the content of the page does not violate English law.

13. You are prohibited from storing, distributing or onward transmission of any unlawful material via our services. Examples of unlawful material include direct threats of physical harm, hardcore and child pornography and copyrighted, trademarked and other proprietary material used without the proper authorisation.

14. You are prohibited from storing, distributing or onward transmission of software containing viruses, Trojan horses, or software designed to compromise the security of other sites.

15. You are prohibited from utilising our services to compromise the security or tamper with our system resources or accounts on our computers or at any other site. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include password guessing programs, cracking tools, and network probing tools.

16. Your web site must not contain or collect any personal data other than in accordance with the Data Protection Act.

17. You must obtain any necessary legal permission for any works included within your web site.

18. You will be held responsible for and therein accept responsibility for any defamatory, confidential, secret or proprietary material made available via you web site.

19. You must ensure that your index.htm, index.html, default.htm or default.html page (being the first page viewed on accessing your site) does not contain any material liable to offend. A suitable message must be displayed prior to any offensive information being displayed.

20. UKMIA accept no responsibility for  hit counters/statistics being reset or inaccurate.

21. You may not advertise your web site, or cause another entity to advertise your web site via UKMIA services, using any techniques that can be classified as aggressive or abusive. This includes, but is not limited to, bulk Email (SPAM) and excessive news posting. Such action will be treated as though the postings originated from your account, and may result in the account being frozen, or terminated.

22. UKMIA shall not be held liable for any loss, however occasioned, as a result of the suspension, removal, or unavailability of a customer’s web site or material stored within it, or email services, or any other Internet services provided by UKMIA.

23. If your account is for any reason barred (including non-payment) access to your web space may be suspended pending resolution of the reason for barring.

24. When you close your account, your web space its content and your login account(s) will be deleted.

25. If you in some way upload files to your web space exceeding your allocated webspace, UKMIA reserve the right to request immediate removal of sufficient files within your webspace to ensure it is within the published webspace limits.

26. UKMIA reserve the right to remove any material from your web space at their sole discretion, without prior notice or explanation.

27. UKMIA reserve the right to suspend any or all of the web space service at any time, without prior notice and without explanation.

28. UKMIA will require sites that show excessive use to be upgraded to a higher usage tariff. The definition of excessive use can be obtained from UKMIA.

29. UKMIA reserve the right to vary the definition of excessive use at their own discretion at any time without prior notice.

30. UKMIA reserve the right to make a charge for any reassessment of suspended sites.

31. Customers must not refer to your home page by any means other than www.accountname.co.uk, nor register your web site anywhere using any other method. Specifically, you must not reference or cause your web site to be referenced by a dotted IP address (eg.123.456.789.000). Such requests may fail.

32. Any IP address that may be allocated to your webspace may change at any time and without notice.

33. The act of copying any files to your webspace and/or use of email services and/or any other Internet services supplied by UKMIA, will deem you to have agreed to all of the terms and conditions of use for the web space, and the related AUP document.

34. UKMIA reserve the right to vary the Terms & Conditions of Use and the Acceptable Use Policy at their own discretion.

35. Any decision made by UKMIA in relation to this service shall be final.

36. You may not send e-mail to any user who does not wish to receive it, either at UKMIA or elsewhere. UKMIA recognise that e-mail is an informal medium; however, customers must refrain from sending further e-mail to a user after receiving a request to stop.

37. Unsolicited advertising mailings, whether commercial or informational, are strictly prohibited. You may send advertising material only to addresses, which have specifically requested it. We will not forward mail of accounts terminated for bulk mailing or unsolicited advertising

38. Chain letters are unsolicited by definition and may not be propagated using our services.

39. You may not send, distribute, or reply to mailbombs. Mailbombing is understood as either e-mailing copies of a single message to many customers, or sending large or multiple files or messages to a single user with malicious intent.

40. You may not alter the headers of e-mail messages to conceal their e-mail address or to prevent Internet users from responding to messages.

41. Violations of some of the AUPs outlined in this document can sometimes result in massive numbers of e-mail responses. If our customers receive so much e-mail that our resources are affected, UKMIA may shut down a customer's mailbox.
